1. About CeriVPN and These Terms
1.1 Service Provider
CeriVPN services are provided by Emerald Cube Sdn. Bhd., a company incorporated in Malaysia with registered address at Level 32, Vertical Corporate Tower B, Bangsar South, Kuala Lumpur 59200, Malaysia.
1.2 Our Service
CeriVPN provides Virtual Private Network (VPN) services that encrypt your internet connection and route it through our secure servers worldwide, protecting your online privacy and enabling secure internet access.
1.3 Agreement Scope
These Terms of Service (“Terms”) govern your use of CeriVPN’s mobile applications, websites, and related services (collectively, the “Service”). These Terms form a legally binding agreement between you and CeriVPN.
2. Eligibility and Account Registration
2.1 Age Requirements
- General: You must be at least 18 years old to use CeriVPN
- EU/EEA: You must be at least 16 years old, or have parental consent
- Minors: If you’re under 18, you must have explicit parental or guardian consent
2.2 Account Registration
To use CeriVPN, you must:
- Provide accurate and complete registration information
- Accept these Terms of Service and our Privacy Policy
- Maintain the security and confidentiality of your account credentials
- Immediately notify us of any unauthorized use of your account
- Use only one account per person (account sharing is prohibited)
2.3 Account Security
You are fully responsible for all activities that occur under your account. We recommend using strong, unique passwords and enabling two-factor authentication where available.
3. Privacy and Data Protection
3.1 No-Logging Policy
CeriVPN operates a strict no-logging policy:
- We do NOT log, monitor, or store your online activities
- We do NOT track which websites you visit
- We do NOT record your browsing history
- We do NOT store connection timestamps beyond technical requirements
- We do NOT keep logs that could identify you or your online behavior
3.2 Limited Data Collection
We only collect data necessary for service provision:
- Account Information: Email address, username, and encrypted passwords
- Payment Information: Processed securely by third-party payment providers
- Technical Information: App version, device type (for compatibility and support)
- Connection Logs: Limited to server load balancing and troubleshooting (automatically deleted within 24 hours)
3.3 Your Rights (GDPR & Global Privacy Laws)
You have the right to:
- Access: Request information about data we hold about you
- Rectification: Correct inaccurate personal data
- Erasure: Request deletion of your personal data (“right to be forgotten”)
- Portability: Receive your data in a structured, machine-readable format
- Restriction: Limit how we process your personal data
- Objection: Object to processing based on legitimate interests
- Withdrawal: Withdraw consent at any time
4. Acceptable Use Policy
4.1 Permitted Use
CeriVPN may be used for:
- Protecting your privacy and security online
- Accessing geo-restricted content where legally permitted
- Securing connections on public Wi-Fi networks
- General internet browsing and communication
- Legitimate business and personal activities
4.2 Prohibited Activities
You agree NOT to use CeriVPN for:
- Illegal Activities: Any activity that violates local, national, or international laws
- Malicious Content: Distributing malware, viruses, or harmful code
- Network Abuse: Attempting to breach, hack, or compromise network security
- Spam and Fraud: Sending unsolicited emails, phishing, or fraudulent activities
- Copyright Infringement: Accessing or distributing copyrighted content without authorization
- Harassment: Stalking, threatening, or harassing individuals
- Child Exploitation: Any activity involving exploitation of minors
- Terrorism: Activities related to terrorism or violent extremism
- Market Manipulation: Illegal trading or market manipulation activities
- Resource Abuse: Activities that significantly impact server performance or other users
4.3 Compliance with Local Laws
You are responsible for ensuring your use of CeriVPN complies with all applicable laws in your jurisdiction. Some countries restrict or prohibit VPN use – you must comply with local regulations.
5. Service Features and Limitations
5.1 Service Tiers
- Coin-Based Access (Mobile App): Mobile app users can earn access to our VPN servers by spending coins earned through watching advertisements. Users can earn 30 coins by watching a 30-second advertisement. 50 coins are required to unlock 10 minutes of VPN server access.
- Premium Tiers: Enhanced features including faster speeds, unlimited data, premium servers, and priority support
🪙 Important Coin System Rules
No Partial Refunds or Time Accumulation:
- Each VPN session requires exactly 50 coins for 10 minutes of access
- If you disconnect before the 10 minutes are complete, you will NOT receive any coins back
- Unused time cannot be saved, accumulated, or carried over to future sessions
- To start a new VPN session after disconnecting, you must spend another 50 coins
- This applies regardless of whether you used 1 minute or 9 minutes of your session
Example: If you spend 50 coins, connect for 3 minutes, then disconnect, you lose the remaining 7 minutes and must spend another 50 coins to reconnect.
5.2 Technical Limitations
- Fair Usage: We may implement reasonable usage limits to ensure quality for all users
- Server Availability: Server availability may vary based on demand and maintenance
- Speed Variations: Connection speeds depend on various factors including your internet connection and server load
- Device Limits: Number of simultaneous connections varies by subscription plan
5.3 Service Availability
While we strive for 99.9% uptime, we cannot guarantee uninterrupted service. Service may be temporarily unavailable due to:
- Scheduled maintenance
- Technical issues or server problems
- Network congestion
- Circumstances beyond our control
- Compliance with legal requests in specific jurisdictions
6. Subscriptions and Payments
6.1 Subscription Plans
- Premium subscriptions are billed according to your selected plan (weekly, monthly, quarterly, annually)
- All prices include applicable taxes where required
- Pricing may vary by region and payment method
6.2 Payment Processing
- Payments are processed securely through third-party payment providers
- We do not store your payment card information
- Payment providers may be located in different jurisdictions
6.3 Refund Policy
- One Week Plan: No money back guarantee
- One Month Plan: 3-day money back guarantee from the date of purchase
- All Other Plans (3 months, 6 months, 1 year, 2 years): 7-day money back guarantee from the date of purchase
- Pro-Rated Refunds: Available at our discretion for service issues
- App Store Purchases: Subject to the respective app store’s refund policy
- Coin-Based Access: No refunds applicable
7. Intellectual Property Rights
7.1 CeriVPN’s Intellectual Property
All content, features, and functionality of the CeriVPN service, including but not limited to software, text, images, logos, and trademarks, are owned by CeriVPN or its licensors and are protected by international copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the CeriVPN application and service for personal use in accordance with these Terms.
7.3 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of our service
- Reverse engineer, decompile, or attempt to extract source code
- Remove or alter any proprietary notices
- Use our trademarks or branding without written permission
8. Third-Party Services and Links
8.1 Third-Party Integrations
CeriVPN may integrate with third-party services for payment processing, analytics, or other functionality. These services are governed by their own terms and privacy policies.
8.2 External Links
Our service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of these external sites.
8.3 No Endorsement
Inclusion of third-party links or integrations does not constitute endorsement of those services or their content.
9. Account Termination
9.1 Termination by You
- You may cancel your account at any time through the app or by contacting support
- Cancellation takes effect at the end of your current billing period
- You remain responsible for all charges incurred before cancellation
9.2 Termination by CeriVPN
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in prohibited activities
- Fail to pay subscription fees
- Attempt to abuse or exploit our service
- Provide false information during registration
9.3 Effect of Termination
- Upon termination, your access to premium features ceases immediately
- We may delete your account data in accordance with our data retention policies
- Certain provisions of these Terms survive termination
10. Disclaimers and Limitation of Liability
10.1 Service Disclaimer
CeriVPN is provided “as is” and “as available.” We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 No Guarantee of Security
While we implement strong security measures, no internet transmission is 100% secure. We cannot guarantee absolute security or privacy of your data or communications.
10.3 Limitation of Liability
To the maximum extent permitted by law, CeriVPN’s total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.
10.4 Excluded Damages
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of data or information
- Business interruption
- Loss of privacy
- Personal injury (except where prohibited by law)
11. Indemnification
You agree to indemnify, defend, and hold harmless CeriVPN, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your violation of these Terms
- Your use of the service
- Your violation of any law or third-party rights
- Any content you submit through the service
12. Jurisdictional and Legal Compliance
12.1 Governing Law and Jurisdiction
- Primary Jurisdiction: These Terms are governed exclusively by Malaysian law and the courts of Malaysia have exclusive jurisdiction over any disputes
- Malaysian Law Supremacy: In case of any conflict between Malaysian law and foreign regulations, Malaysian law shall prevail
- Regional Compliance: We make best efforts to comply with applicable laws in jurisdictions where we operate, subject to Malaysian law and our operational capabilities
- Limited Scope: Our compliance obligations are limited to what is technically and commercially feasible for a Malaysian-based company
12.2 Law Enforcement Cooperation
While we maintain a no-logging policy, we may be required to cooperate with valid legal requests from Malaysian law enforcement agencies. However, due to our no-logging policy, we have limited data to provide. International requests must comply with Malaysian legal procedures and mutual legal assistance treaties.
12.3 Privacy and Regulatory Standards
- PDPA (Malaysia): Full compliance with Malaysian Personal Data Protection Act as our primary legal obligation
- GDPR (EU): We are committed to GDPR-inspired privacy principles where technically and commercially feasible, subject to Malaysian law
- CCPA (California): We strive to provide CCPA-style privacy rights where practically possible, subject to local regulations
- Regional Laws: Best efforts compliance with applicable telecommunications and privacy laws, within our operational capacity as a Malaysian company
- Resource Limitations: Our compliance efforts are subject to our available resources and technical capabilities
13. Dispute Resolution
13.1 Informal Resolution
Before initiating formal proceedings, we encourage you to contact us directly to resolve any disputes. Most issues can be resolved through our customer support team.
13.2 Formal Dispute Resolution
- Malaysian Courts: All formal disputes must be resolved in Malaysian courts under Malaysian law
- Mediation: Disputes may be resolved through mediation in Malaysia before resorting to litigation
- Arbitration: Where agreed by both parties, disputes may be resolved through arbitration in Malaysia under Malaysian arbitration rules
- Foreign Jurisdiction: We do not consent to jurisdiction in foreign courts
13.3 Class Action Waiver
Where legally permissible under Malaysian law, you agree to resolve disputes individually and waive the right to participate in class action lawsuits.
14. Updates and Modifications
14.1 Service Updates
We may update, modify, or discontinue features of the CeriVPN service at any time. We will provide reasonable notice for significant changes that affect functionality.
14.2 Terms Updates
- We may update these Terms periodically to reflect changes in our service or legal requirements
- We will notify you of material changes via email or in-app notification
- Continued use of the service after changes constitutes acceptance of updated Terms
- If you don’t agree with updated Terms, you may cancel your account
14.3 Version Control
We maintain version control of our Terms and will clearly indicate when changes are made and what has changed.
15. Special Provisions by Region
Important Note: The following regional provisions represent our commitment to privacy best practices but are subject to Malaysian law, our operational capabilities, and available resources. They do not create binding legal obligations beyond what is required under Malaysian law.
15.1 European Economic Area (EEA)

- Best Efforts Response: We will make reasonable efforts to respond to data subject requests within a reasonable timeframe
- Privacy Rights: We aim to provide GDPR-inspired privacy rights where technically feasible

15.2 United States
- Privacy Commitment: We are committed to providing CCPA-inspired privacy practices where practically possible
- Children’s Privacy: Our service is not directed at children under 13
- State Laws: We make reasonable efforts to respect state privacy laws where feasible
- Jurisdictional Limits: Subject to Malaysian court jurisdiction and legal procedures
15.3 Asia-Pacific
- Local Regulations: We comply with local telecommunications regulations where we have servers
- Data Localization: Subject to technical feasibility and our server infrastructure
- Regional Privacy Laws: Best efforts compliance with regional privacy laws (PDPA, PIPA, etc.) within our operational capacity
16. Accessibility and Language
16.1 Accessibility
We strive to make our service accessible to users with disabilities and continuously work to improve accessibility features, subject to our technical and financial capabilities.
16.2 Language Versions
These Terms may be translated into other languages. In case of discrepancies, the English version prevails, and Malaysian law governs interpretation.
17. Force Majeure
CeriVPN shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, internet outages, third-party service failures, or changes in applicable laws or regulations.
18. Severability
If any provision of these Terms is deemed invalid or unenforceable under Malaysian law, the remaining provisions shall continue in full force and effect. Invalid provisions shall be replaced with valid provisions that most closely reflect the original intent while complying with Malaysian law.
19. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and CeriVPN regarding the service and supersede all prior agreements and understandings. This agreement is governed by Malaysian law.
